1st Applicant: 7 Waterstone Road/Benjamin’s Steakhouse and Hotel
Bob Zimmer- Summarizes where the application has left off, applicants’ engineers were working on the docks, stormwater management plan and traffic study all needed to complete SEQR review.
Dan Getz (applicant’s engineer)- The DEC we actually heard back today, it’s just about the right to have the docks in the lake which is something we all discussed. Benjamin has something in his deed that addresses it. We’re going to submit that back to them. The traffic study, I am not doing the study myself so I don’t know those details. For the storm water management plan, we had the engineer’s comments regarding the submitted revised plan, since those comments we have been working on that. It brought up some issues that we need to address to ensure we have conformity with the state, the biggest issue with those is the size discrepancy. I made the mistake and we will correct that. The holding is supposed to be like 20,000 gallons. We’re going to propose some stormwater planters to reduce the size that the holding tank would need to be. One of the issues that was also brought up in that letter was the question of how we’re going to use all that water so that the tank doesn’t just sit full all the time. We’re going to be using it for watering plants but we’re also looking into other ways to use that water. Right now, there are no measures on the property at all for storm water mitigation and as it existed before there never had been for the history of the property has run off into the lake, so what we showed before would be an improvement in in that sense over the existing but it’s it doesn’t quite meet the state standards.

Dan Getz- The DOH is basically satisfied but they’re waiting on the DEC to approve, in this case the DEC was waiting on a thread in endangered species habitat assessment on the SEQR one of the things you had put down that was timber snake habitat because they are in the area. We had someone look into it and I can distribute if you want a letter that says April 1st and October 31st the site does not contain Denning basking gestating or potential foraging habitats with the east arm of Greenwood Lake forming the southern and eastern boundaries no travel corridors are located within the project boundaries.
The DEC should clear the threatened species. The traffic study, we’ll get it to them as soon as we can.

2nd. Applicant: 6 Van Orden
Bob Zimmer- Another continuing application, there were some minor changes that needed to be made to the plan and you submitted those back.
Discussion about septic and a new submittal for that as well…
Overlapping conversation about the septic and the protection of.
Bob Zimmer- We like for after construction to have a flow test, to ensure it is in working order and hasn’t been impacted by construction activity.
Anyone else have any other comments on this?
Jack Sirios- If the field is this way, you need to show that on the drawings on the drawing that you’re going to give it to the Building Department, alright you’re already showing the location of the new tank so that’s no problem.

3rd. Application: 11 Co Hwy 5
Bob Zimmer- Another continuing application, last time the septic system was in potentially wetland so you had to either get rid of the wetland concern or re-design the system. Based upon e-mail correspondence, the DEC acknowledged that it is not a wetland concern there, so you don’t have to change the septic system and we are good to go.
Scott Lehr (Applicant)- There were some other minor changes that need to be changed on the plan. Brian (Engineer) addressed.
Bob Zimmer- Jamie reviewed them all and said for the most part that they were not a concern anymore. So based upon Jamie’s review of it seems all OK.
Scott Lehr- OK on the side note from that like I said I have the note from the neighbor for the easement for the construction of the wall.
Bob Zimmer- It is important for you to understand that when we approve this, you’re not approved to do anything on the neighbors’ property. That agreement that you can, if his property collapses during the wall construction, that’s between you and him, that has nothing to do with this board, we’re only approving the plans that you submitted, that have that do not have anything to do with this property and in no way are we saying that it’s OK for you to do anything on his property. That’s a separate thing for you and the neighbor.
Scott Lehr- Understood. Additionally, there was a on this C form there was a correction that needed to be made, a small correction I can submit that to the board.
Bob Zimmer- Let me just clarify since this application at the ZBA was restricted to personal use only, would this all become a residential use and a type 2 application type 2 SEQR review? Since it can only be for his personal use?
Alyse Terhune- Yes
Bob Zimmer- If you could clarify that for the record, that would be great.
Scott Lehr- Just what the change was?
Bob Zimmer- And submit those changes to the file.
Scott Lehr- So, yeah it was just a there was a typo for the acreage to be disturbed, it was marked as .11 but it is .47 acres.
Bob Zimmer- OK, thanks. It’s one of the things that was a major change between whether this was for your own use or whether you wanted to lease out a portion of the property. Determined whether or not we were going to have to do a SEQR review on it.
Alyse Terhune- If it is for personal use only, per your ZBA variance.
Scott Lehr- That’s what we decided just because I don’t have the answers for who would go in the space, so if it ever comes up later on, it’ll have to be reviewed by the ZBA.
