MAYOR DWYER STATED THIS HEARING IS ON SHORT TERM RENTAL PROPERTIES. THIS IS A PROPOSED NEW CODE THAT DOES CALL FOR A PUBLIC HEARING. WE HAVE HAD EXTENSIVE PUBLIC MEETINGS ON THIS ISSUE FOR NEARLY A YEAR. WE HAVE HAD A LOT OF PUBLIC INPUT AT THE MEETINGS AS WELL AS EMAILS, PHONE CALLS AND LETTERS. WE HAVE DISCUSSED EVERYTHING AND THE BOARD HAS PUT TOGETHER WHAT WE FEEL IS THE BEST LAW FOR OUR COMMUNITY. IT HAS BEEN POSTED ON OUR WEBSITE FOR A MONTH AND WE HAVE COPIES HERE.   WE HAVE NOT FULLY RECEIVED COMMENTS FROM OUR ZONING BOARD, BUT WE HAVE RECEIVED COMMENTS FROM THE PLANNING BOARD, THE ORANGE COUNTY PLANNING DEPARTMENT AND THE TOWN OF WARWICK. WE CANNOT CLOSE THE PUBLIC HEARING TONIGHT AS WE HAVE TO GIVE THE ZONING BOARD 62 DAYS BY LAW TO COMMENT.   IN MARCH WE CAN CLOSE THE MEETING IF WE CHOOSE.

MAYOR DWYER – ITS HARD TO SURVEY THE COMMUNITY. THE MOST VOCAL ARE THOSE IN FAVOR BUT I DON’T THINK THEY ARE A GOOD CROSS SECTION OF THE COMMUNITY. I KNOW THERE ARE A LOT OF VIEWPOINTS AND I THINK THE LAW WE ARE PROPOSING ADDRESSES A LOT OF THE THINGS THAT PEOPLE ARE AGAINST AIRBNB’S HAVE BROUGHT UP. IT PRETTY MUCH GUARANTEES THAT THEY WILL BE COME MORE FRIENDLY NEIGHBORS WHICH IS WHAT MOST RESIDENTS ARE ASKING FOR. THE LAW CREATES THE SITUATION THAT THE VILLAGE BOARD CAN REVOKE ONE’S ABILITY TO OPERATE AN AIRBNB IF THEY ARE BEING A SO CALLED UNFRIENDLY NEIGHBOR (EXCESSIVE GARBAGE, EXCESSIVE NOISE, ETC. THERE WILL BE STEEP FINES TO PAY IF THEY DO SO. WE CAN’T GUARANTEE THIS WILL SOLVE THE ISSUES, BUT THIS PUTS THE HOMEOWNER ON NOTICE THAT THEY WILL BE HELD RESPONSIBLE. EVERY OWNER NEEDS TO POST A CLEAR SET OF RULES TO BE FOLLOWED.

FROM THE STANDPOINT OF A TOWN COUNCILMAN I THINK THE TOWN WOULD DO WELL TO ADOPT A SIMILAR LAW. AS A CITIZEN OF THE VILLAGE I THINK ITS ABSOLUTELY NECESSARY. THE SANCTITY OF YOUR HOME SHOULDN’T BE INVADED BY SOME VACATIONER NEXT DOOR WHO DOESN’T REALLY CARE. I THINK IT’S A GOOD IDEA.

 

MAYOR DWYER – WE CAN’T CREATE PERFECT NEIGHBORS, WHEN THEY ARE HOMEOWNERS AS WELL. FOR EXAMPLE, IF YOURE DOG BARKS CONSISTA

 

NTLY YOU ARE GIVEN A $25.00 FINE. IF YOU ARE AN AIRBNB OWNER AND CONSISTELNLY RENT TO PEOPLE THAT ALLOW THEIR DOGS TO BARK CONSTANTLY WE CAN PULL YOUR PERMIT. WE ALSO WANT TO PROMOTE TOURISM SO WE NEED THE RIGHT BALANCE. WE WANT TO ENCOURAGE THAT BUT NOT NEGATIVELY IMPACT OUR YEAR-ROUND RESIDENTS.
